COMPANION DOG CONTRACT
· We, Jerry and Lanette Godsey (hereinafter designated as BREEDER), guarantee this Boston Terrier puppy to be healthy and free of disease upon receipt by BUYER. Every effort has been made by BREEDER to produce a litter both physically and mentally sound. BREEDER will stand behind this breeding to the extent stated below. However, BUYER accepts full responsibility for the proper care once the pup leaves the BREEDER. BREEDER cannot be held responsible for the death, injury, deformity, or temperament of the pup due to illness, accident, or deviation from adequate care herein stated and socialization required for a Boston Terrier.
· I, ________________________ (hereinafter designated as BUYER), agree to have this puppy examined by a licensed veterinarian within three (3) days of receipt. If health problems are found, the animal may be returned to BREEDER within seven (7) days for a replacement puppy if one is available or when one becomes available or a reimbursement.
· This dog is being sold as a "Companion animal". It is highly recommended that the BUYER have this dog spayed/ neutered by six to eight months of age.
· All puppies are sold with Full Registration.
· A $200 (non-refundable) deposit will be required to hold (Buyer's) Boston Terrier. If you decide you do not want the Boston Terrier you will lose your deposit, and Godsey’s Bostons will find a new owner for the Boston Terrier. The remainder amount owed on the Boston Terrier will be paid at Pick Up (8-10 weeks of age) or if shipped (10 weeks of age).
· BREEDER guarantees that this dog has no obvious defects.
· GUARANTEE: This puppy/dog is guaranteed to be free of any inherited defect resulting in a significantly shortened life span (i.e. the dog dies or has to be euthanised prior to 2 years of age because of this diagnosed defect AND the accepted current veterinary medical therapies have failed to afford the dog an acceptable quality of life.) Determination of what constitutes a hereditary defect is to be a unanimous agreement of two (2) veterinarians agreeable to both parties. Costs of the opinions are to be assumed by the buyer. If such a problem should develop, the breeder shall replace the puppy/dog free of charge to the owner if the defect of the dog is severe enough to warrant the animal to be destroyed (as deemed by a qualified veterinarian.) The decision is between the breeder and owner and fulfilled within one year of the problem developing. This guarantee does not apply to any damage, neglect or injury caused by negligence, improper nutrition/health care, accident or if the dog has been bred.
· If BUYER is unable to keep this pup/dog for any reason, BUYER agrees to return it to BREEDER and foregoes all rights to said puppy/dog. This puppy/dog may not be sold, given away, placed in an Animal Shelter, or euthanised without written permission of BREEDER. The exception to euthanasia would be in the case of severe injury or suffering on the part of the dog.
· BUYER agrees to provide an adequate home to ensure this dog's safety; and to provide adequate protection from excessive heat and cold. This dog shall be neither chained, continuously tied, or allowed to roam at large.
· BUYER agrees to provide adequate veterinary care and to provide necessary medical treatment in the event of an accident/injury to the dog. It is highly recommended that BUYER take this dog to puppy kindergarten and/or obedience classes.
· BUYER agrees to pay _________ and NO/100 dollars for this Boston Terrier, to be delivered by BREEDER according to mutual agreement as specified below or picked up by BUYER. Payment must be received in full by cash or cashier’s check made payable to “Lanette Godsey" before puppy is delivered to BUYER or at time of pick-up.
· All transportation expenses are the responsibility of BUYER. Air shipping is available, however, it is preferred that BUYER pick up the puppy in person.
· The BUYER agrees to inform BREEDER of any titles or awards obtained by the animal for our breeding records.
· The BUYER will inform The BREEDER of any change of address or phone number so that we may keep track of all animals bred by this kennel.
· The BUYER understands that this puppy is sold with full _______ registration.
· BREEDER recommends a “Titer” test be done at 1, 3 and 6 years of age to see if said dog needs to be re-vaccinated. BREEDER will not be responsible for any immune problems such as mange, skin allergies, seizures or intestinal disorders that may occur after vaccinating this puppy.
· Violations of the terms of this contract renders all guarantees stipulated in this contract to be null and void and may result in the buyer being required to return the Puppy/Dog to the BREEDER within five days of receipt of written notice from the BREEDER. No refund will be given to the BUYER in this event.
· The BUYER will sign the registration papers transferring ownership back to the Breeder, and surrender the Dog, the registration papers and the contract back to the BREEDER.
· If the BUYER fails to return the Puppy/Dog when requested in writing for failure of contractual obligations, the BREEDER reserves the right to immediately repossess the Puppy/Dog, the Dog's registration papers (signed by the BUYER transferring ownership back to the BREEDER) and this contract.
· The BREEDER reserves the right to pursue any and all other remedies as provided by law, including pursuit in a court of law, of return of the Puppy/Dog to the BREEDER, compensatory damages, attorney fees and court costs.
This agreement is made and entered into
in the State of California and shall be enforced and interpreted under the laws
of this State.
The undersigned BUYER hereby
acknowledges having read the terms of the contract and does hereby agree to
abide by each of the provisions set forth above.
